The Archive fee is only A$10.00 [Ten Australian Dollars] per annum. (see Archive) A valid Will is the only legal way to ensure that your chosen beneficiaries receive all, or a share,of your estate, that you bequeath to them. To validate your Will, it must be signed and dated in the presence of at least two witnesses. Remember that witnesses are only validating your signature and do not need to know the terms of the Will. Whereas you are signing your will at the end, it is unlikely that your will uses only one page. To safeguard the previous pages sign and witness them in the left hand margins. No witness, or relative to the witness, should benefit under the terms of the Will. All signatories should be done at the same time. Whereas a Notary Public (Justice of the Peace) is not a requirement, we would recommend that you use them as one of your witnesses. It may strengthen your directions in the event of litigation. It is advisable that all individuals have their own Wills. Joint Wills are permissible however they have been known to cause undue “legal complications”. To avoid any complications, separate Wills are advisable. Their may be situations wherein it may be preferable to appoint an Executor (see Executor) to ensure that your estate is administered as per your instructions. (see Legal) Parts of your estate may be willed to individuals in the form of Gifts. A Legacy is a monetary gift, a Bequest is usually personal property (watch, picture, car, jewelry etc.), a Devise specifically relates to Real Estate. After taking care of individual requirements, the remainder of your estate is willed to whomsoever you instruct. This residual beneficiary is usually your major beneficiary. If the gifted beneficiaries do not survive you, their entitlements normally pass on to the residual beneficiary.(see Archive) It is highly recommended that you Archive your Will.
